I understand that the horse I am acquiring is from an auction and therefore has an unknown history (schooling, vices, behavioural concerns), temperament, training, health and soundness. I understand that for the safety of any other horses I own, I should quarantine this horse for at least 30 days in case he/she has been exposed to strangles or any other communicable virus. I further understand that auction horses should always be seen by a farrier, an equine dentist and a vet upon arrival. I therefore understand that there are additional expenses that I will incur upon the arrival of the horse I choose. _______(initials).

This document, in it’s complete and unaltered form, will constitute the transfer of ownership of the horse, (Camelot auction date and hip number)____________________________ , from Bright Futures Farm, Inc (current owner) to (your full name)___________________________________________________ for the sum of $____-0-_____ after the horse has been in your care for a minimum of 120 days and updated photos, proof of vetting, dental and farrier have been provided to Bright Futures Farm to show the horse is being well cared for. _________initials.

Transferee agrees that if said horse is to be re-sold or given away that transferee will:

1. Offer Bright Futures Farm, Inc. a first right of refusal to repurchase said horse for $__-0-__, and that Bright Futures Farm, Inc. will be permitted 5 calendar days to make a decision as to whether or not they will exercise their first right of refusal.

2. If Bright Futures Farm, Inc. does not exercise their first right of refusal to repurchase said horse, transferee agrees that transferee will exercise caution when transferring said horse to another individual so that said horse transfers to “good hands” once again. Transferee further agrees that said horse will never be sold by or given by transferee (or an agent/representative acting on behalf of transferee) to a dealer, kill buyer or sent to an auction.

If you transfer ownership of this horse in the future, we strongly encourage you to inform the new owner the circumstances by which you acquired this horse, and advise the new owner that they always have recourse to contact Bright Futures Farm if they should need to re-home this horse in the future.

Bright Futures Farm makes no warranties expressed or implied as to the soundness or temperament of this horse. Transferee understands this horse was purchased at an auction with no pre-purchase exam and no recent history available.

Please read and initial: Transferee agrees to indemnify and hold harmless, Bright Futures Farm, Inc., and/or Beverlee Dee and their agents, affiliates, successors and assigns, et al, for any damage or injury caused to any person or property by said horse at any time and any place hereafter. Transferee understands and agrees that indemnity extends to all foreseeable and unforeseeable costs and attorneys fees associated with responding to such claims. ______________(initials)

Completion of this agreement requires the signature of the transferee and spouse (if married). Upon receipt of a signed, completed agreement, current owner will release said horse to transferee after an agreed upon probationary period of 120 days. If after 120 days the horse has not been seen by a farrier, vet and equine dentist (it is acceptable for your vet to examine your horses’ teeth for us), the horse will be returned to Bright Futures Farm at the transferee’s expense.
